Colonie Apartments ("Colonie," "we," "us," or "our") owns and operates the apartment community at 1 Durham Dr, Amherst, NY 14228 and the website colonieamherst.com (the "Site"). This Privacy Policy explains what information we collect, how we use and protect it, the limited ways we share it, and the choices you have, including for our text message (SMS) program.

This Policy applies to information collected through the Site, by phone, by email, by text message, and in person at our leasing office. By using the Site or contacting us, you agree to this Policy. If you do not agree, please do not use the Site.

2. Information We Collect

Information you provide to us

• Contact and inquiry information, such as your name, email address, mobile phone number, preferred floor plan, desired move-in date, and any message you send when you request a tour or contact us.
• Text messaging information, such as your mobile phone number, your opt-in consent (including the date, time, and method of consent), and your messages to and from us.
• Communications, including information you share when you call, email, text, or visit us.

Rental applications and resident accounts

Rental applications and the resident portal are provided through Rent Manager, a third-party property management platform. Information you submit there (for example, identification, income, rental history, and payment information) is collected through that platform and used to process your application and manage your tenancy as described in Section 3. Please do not send sensitive information such as Social Security numbers or bank account numbers by email or text message.

Information collected automatically

When you visit the Site, our hosting provider and the third-party services described in Section 7 may automatically receive basic technical information, such as your IP address, browser type, device type, referring page, pages viewed, and the date and time of your visit.

3. How We Use Your Information

We use the information we collect to:

• Respond to your questions and schedule and confirm tours;
• Provide information about apartment availability, pricing, and leasing;
• Process rental applications and administer leases;
• Send service-related communications to applicants and residents, such as maintenance updates, payment reminders, and community notices;
• Send text messages to people who have opted in, as described in Section 4;
• Operate, maintain, secure, and improve the Site;
• Comply with legal obligations, including fair housing laws, and enforce our agreements.

We do not sell your personal information.

4. Text Messaging (SMS) Program

If you opt in, Colonie Apartments may send you text messages related to tour scheduling and reminders, leasing and application updates, maintenance and service notices, payment reminders, and community announcements.

• Consent. We send text messages only to people who have given express consent, for example by checking the SMS consent box on our tour request form, completing an opt-in through our leasing office or resident portal, or texting us first. Consent to receive text messages is not a condition of renting an apartment or purchasing any goods or services.
• Message frequency varies based on your inquiry or tenancy.
• Message and data rates may apply, according to your mobile carrier's plan.
• Opt out at any time by replying STOP to any message. You will receive one confirmation message, and we will stop sending text messages to that number.

• Mobile carriers are not liable for delayed or undelivered messages.

5. How We Share Information

We do not sell, rent, or trade your personal information. We share personal information only in the limited situations below:

• Property management and service providers who perform services on our behalf (such as our property management company, rental application and resident portal provider, and website hosting provider), only as needed to provide those services and subject to confidentiality obligations;
• Legal requirements, when required by law, subpoena, court order, or other legal process, or to respond to lawful requests from government authorities;
• Protection, to protect the rights, property, or safety of Colonie Apartments, our residents, staff, or others;
• Business transfers, in connection with a sale, refinancing, or change in ownership or management of the property, in which case this Policy will continue to apply to your information.

6. Cookies and Similar Technologies

The Site does not set its own advertising or tracking cookies. Third-party services embedded on the Site, such as Google Maps, may use cookies or similar technologies under their own privacy policies. You can block or delete cookies through your browser settings; some embedded features may not work properly if you do.

7. Third-Party Services and Links

The Site uses or links to services operated by others, each of which has its own privacy policy and terms:

• Rent Manager, for online rental applications and the resident portal;
• Google Maps and Google Fonts, to display our map and text, which may receive your IP address and browser information when they load;
• Our website hosting provider, which may keep standard server logs.

We are not responsible for the privacy practices of third-party services. We encourage you to review their policies.

8. Data Retention

We keep personal information only as long as needed for the purposes described in this Policy, including to respond to your inquiry, administer a lease, and meet legal, accounting, and record-keeping requirements. Records of text message consent and opt-out requests are kept as long as needed to honor your choices and demonstrate compliance.

9. Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission over the internet, by email, or by text message is completely secure, and we cannot guarantee absolute security.

10. Your Choices and Rights

• Text messages: reply STOP to any message to opt out, or HELP for assistance.
• Email and phone: ask us at any time to stop contacting you about leasing.
• Access, correction, and deletion: you may ask to review, correct, or delete contact information you have provided, subject to any legal or lease-related obligations that require us to keep certain records.

To make a request, contact us using the information in Section 13. We will not discriminate against you for exercising any of these choices.

11. Children's Privacy

The Site is intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated Policy on this page and change the "Last updated" date above. Material changes to how we handle text messaging opt-in data will not apply to information collected before the change without your consent.
