1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of colonieamherst.com (the "Site") and our text message program, operated by Colonie Apartments ("Colonie," "we," "us," or "our"). By using the Site or opting in to text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Information on the Site

We try to keep the Site accurate, but rents, fees, deposits, availability, floor plans, square footage, amenities, policies, and photos may change without notice and are not guaranteed. Floor plans and photos are for illustration only and may not show the exact apartment you rent. Nothing on the Site is an offer to rent or a guarantee of availability. Please contact the leasing office to confirm current details.

3. Applications and Leases

Applying does not guarantee approval. All applicants are subject to our screening criteria, and application fees are non-refundable except where required by law. Your rights and obligations as a resident are governed solely by your signed lease and its addenda, which control over anything on the Site.

4. Text Messaging (SMS) Terms

• Program: Colonie Apartments sends text messages about tour scheduling and reminders, leasing and application updates, maintenance and service notices, payment reminders, and community announcements.
• Opt-in: you will receive text messages only if you have given express consent, such as by checking the SMS consent box on our tour request form, opting in through our leasing office or resident portal, or texting us first. Consent is not a condition of renting or of any purchase.
• Message frequency varies.
• Message and data rates may apply.
• To opt out, reply STOP to any message. You will receive one final confirmation message. To opt back in, contact the leasing office or text START.

• Mobile carriers are not liable for delayed or undelivered messages.
• Privacy: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy.

5. Third-Party Sites

The Site links to services operated by others, including our online rental application and resident portal (Rent Manager) and Google Maps. We do not control these services and are not responsible for their content, availability, or practices. Your use of them is subject to their own terms.

6. Acceptable Use

You agree not to misuse the Site, including by attempting to interfere with its operation, gain unauthorized access, send unlawful or harassing communications, or copy or use Site content for commercial purposes without our permission.

7. Intellectual Property

The Site's text, photos, floor plans, logos, and design belong to Colonie Apartments or its licensors and are protected by law. You may view and print pages for your personal, non-commercial use.

8. Fair Housing

Colonie Apartments is committed to equal housing opportunity. We do not discriminate on the basis of race, color, religion, sex, national origin, disability, familial status, or any other characteristic protected by federal, New York State, or local law. 9. Disclaimer of Warranties

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, Colonie Apartments and its owners, managers, and employees will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site or the text message program.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the "Last updated" date above. Continued use of the Site means you accept the updated Terms.
